Agreement

By accessing CarbTesters.org, you agree to these terms. If you do not agree, do not use the site.

What we provide

We offer an independent directory-style search experience to help users locate credentialed testers relevant to Clean Truck Check. We are not CARB, not a government agency, and not the official tester registry. See our Disclaimer for data limitations.

Acceptable use

You agree not to:

Use the site or tester contact information to harass, spam, scrape for unsolicited marketing, or send bulk messages without a legitimate trucking or compliance-related purpose;
Attempt to disrupt the service, probe for vulnerabilities, or bypass technical limits;
Misrepresent your identity or affiliation, or imply that we or CARB endorse your communications when that is not true;
Rely on this site as the sole source for legal compliance — you remain responsible for meeting CARB and other applicable requirements.

We may suspend or block access for behavior that harms users, testers, or the service.

Content on CarbTesters.org is informational. It is not legal, regulatory, or mechanical advice. Consult CARB, qualified counsel, or qualified technicians as appropriate.

Disclaimer of warranties

The site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, Bobega LLC and its owners, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of CarbTesters.org. Our total liability for any claim relating to the service is limited to the greater of (a) fifty U.S. dollars or (b) what you paid us to use paid features in the six months before the claim — if neither applies, fifty U.S. dollars.

Indemnity

You will defend and indemnify us against claims arising from your use of the site, your messages to testers, or your violation of these terms, except to the extent caused by our intentional misconduct.

Governing law & venue

These terms are governed by the laws of the State of California, excluding conflict-of-law rules. You agree that exclusive jurisdiction for disputes lies in the state or federal courts located in California, subject to applicable consumer protections that cannot be waived.

Changes

We may update these terms by posting changes with a new “last updated” date. Material changes may also be noted on the home page or by email where we have your address. Continued use constitutes acceptance.
